Welcome to SafeGear Auto. These Terms of Use (“Terms”) govern your access to and use of safegearauto.com and related pages (the “Site”). By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. Who we are — important disclaimer

SafeGear Auto is not an insurance company, insurance carrier, underwriter, insurance agency, broker of record, or fiduciary. We operate a free informational, referral, and marketing service that may connect consumers with third-party partners (including insurers, agencies, and related service providers). We do not issue policies, bind coverage, adjudicate claims, or guarantee that any partner will offer you a quote, rate, or product.

Any insurance products are offered solely by licensed third parties. Decisions about coverage, premiums, eligibility, and claims are made exclusively by those parties under their own terms.

2. Eligibility

You must be at least 18 years old and able to form a binding contract under U.S. law to submit forms on the Site. The Site is intended for use within the United States. You represent that information you submit is accurate and that you are the owner of the contact details provided (or are authorized to use them).

3. Nature of the service

The Site provides educational content, partner directories, and lead-matching tools. When you submit a quote request:

• You ask us to share your information with one or more partners who may contact you
• You understand that matching depends on partner availability, licensing, capacity, and criteria we do not fully control
• You acknowledge that quotes, prices, and coverage descriptions from partners may change and may not reflect final offers until you complete their application processes

We may receive marketing or referral compensation from partners when you interact with them. Compensation does not increase the premium a carrier charges for a policy solely because you used our Site, but it may influence which partners receive leads.

4. No professional advice

Content on the Site is for general informational purposes only and is not legal, tax, financial, or insurance advice. Always consult a licensed insurance professional or advisor about your specific situation. Do not rely on Site content as a substitute for reading policy documents.

5. User responsibilities

You agree not to:

• Submit false, misleading, or another person’s information without authorization
• Use the Site for unlawful, fraudulent, harassing, or abusive purposes
• Scrape, harvest, or bulk-download partner listings or Site content in a manner that burdens our infrastructure or violates these Terms
• Attempt to probe, scan, or test the vulnerability of the Site without authorization, or interfere with Site security
• Reverse engineer or copy Site materials except as allowed by applicable law
• Use automated systems to submit leads or spam forms

We may suspend or terminate access if we reasonably believe you violated these Terms.

6. Consent to contact

By submitting a form that includes consent language, you authorize SafeGear Auto and participating partners to contact you at the phone number and email you provide regarding insurance and related offers, including via autodialed or prerecorded calls and text messages, subject to applicable law (including the Telephone Consumer Protection Act). Consent is not required as a condition of purchasing goods or services. You may revoke marketing consent as described in our Privacy Policy; transactional or service messages may still be sent when appropriate.

7. Intellectual property

The SafeGear Auto name, wordmark, logos, Site design, and original content are owned by SafeGear Auto or its licensors and are protected by U.S. and international intellectual property laws. You may view and temporarily store pages for personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works from Site materials without prior written permission, except for brief quotations with attribution for non-commercial commentary.

Partner names and marks appearing in the directory are the property of their respective owners and are used for identification only. Listing does not imply affiliation beyond participation in our referral network, nor endorsement of every product those organizations offer.

8. Third-party services

Partner websites, quotes, applications, and communications are controlled by third parties. We do not warrant their accuracy, availability, licensing status in your state, or privacy practices. Your dealings with partners are solely between you and them.

9. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT REFERRALS WILL RESULT IN ANY QUOTE OR SAVINGS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFEGEAR AUTO AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR INTERACTIONS WITH PARTNERS, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.

11. Indemnification

You agree to defend, indemnify, and hold harmless SafeGear Auto and its affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right in connection with information you submit.

12. Governing law and disputes

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your state of residence apply. Exclusive venue for disputes not subject to small-claims court shall be state or federal courts located in the United States, unless applicable law requires otherwise. You and SafeGear Auto waive any right to a jury trial to the extent permitted by law. Class action waivers may apply where enforceable; nothing here limits non-waivable statutory rights.

13. Changes

We may modify these Terms at any time by posting an updated version on the Site with a revised “Last updated” date. Material changes may be called out on the Site. Continued use after changes take effect constitutes acceptance. If you do not agree, stop using the Site.

14. Miscellaneous

These Terms, together with the Privacy Policy, constitute the entire agreement between you and SafeGear Auto regarding the Site. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a corporate transaction. Headings are for convenience only.
